1. This website [TenantsForum.net] is owned and operated by TENANTSFORUM LLC [affordable Housing  Advocate]. The below sets forth the terms and conditions under which you may use our website and services offered by us. This website offers information regarding Tenants Rights, Rent Regulation processing details & consultancy, as well as a Forum space for Visitor interaction. By accessing or using the website of our service, you agree that you have read, understood, and are bound by the Terms and Conditions herein.

 

2. Our website – Tenants Forum.net is set up to serve Regulated Tenant Communities across the United States. However, this initial offering is specifically for the Regulated Tenant Community of the State and City of New York. By using our website, you indicate/agree that you are of legal age and/or possess the legal authority to enter into these Terms as a binding agreement.

 

3. Disclaimer: Our consultancy, whether at the interactive Forum or ‘Consult-A-Specialist’ Service, is not a substitute for proper legal advice. The Consultants here, though retired DHCR Rent Program Specialists, may or may not be lawyers, and above all, the information/service provided to you cannot guarantee a positive outcome /success in your issues/cases at DHCR/HPD/DOB. Your use of our services/advice indicates that you agree to hold us – TenantsForum LLC/website/Consultants and Affiliates, harmless of any injuries and/or damages of any sort.

4. The introductory Service Fee stated on the website for ‘Consult-A-Specialist’ Service of $19.99 is nominal and without tax. The fee for this specific service and any other charges you may incur in connection with your use of such services, such as taxes and possible transaction fees, will be charged at the check-out counter. You agree that this Fee is non-refundable, and that ‘we’ [TenantsForum LLC.] reserve the right to change the fee or charge additional fees which we deem necessary with proper Notice at the Service Purchase and/or specific areas of the site to inform Users before any such Fee changes take effect. TenantsForum LLC may also out-source this Service.

 

• By your use of the website’s Community Forum, you agree that TenantsForum LLC may charge a subscription fee of no less than $17.50 per year for Forum Access, plus $7.50 as your Donation to the Tenant Organization of your choice on the Forum. If User has not joined any Tenant Organization in the Forum for that year, the Forum Access subscription for such year will be $24.99. You agree that any part of this Fee is non-refundable. 

 

• TenantsForum LLC may become affiliated with various non-profit Tenant Organizations [with proper 501c certifications].

Such Organizations upon proper request may be granted access to the Forum. By using TenantsForum.net you agree to receive Notifications and promotional messages including Donation Solicitations from Tenant Organizations, by email or any other contact form you may provide us with.  If you don't want to receive such promotional materials or notices – you may ‘unsubscribe’ to such notices or contact us at info@TenantsForum.net at any time.

5. TenantsForum LLC reserves the right to change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason. You agree that TenantsForum LLC may go through any of these processes such as may be presented to us by the hosting platform without prior notice to you - the site User.

 

6. Our website Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of TenantsForum LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof without the explicit consent of TenantsForum LLC.

You recognize and agree that you are solely responsible for any content you upload on this site (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, and you hereby confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

 

8. We [TenantsForum LLC] reserve the right to permanently or temporarily terminate or suspend your access to the service/website without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You [User] may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to subscriptions to paid services, such as (a): ‘Consult-A-Specialist’, subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment. (b): Subscription to the Community Forum:- Violators [including -of the Forum rules] will be suspended after 2 cautions, and may permanently be terminated after/upon a third infraction/violation. You agree that subscriptions in this category are Non-Refundable.

 

 

9. You agree to indemnify and hold ‘Us’ [TenantsForum LLC] and Affiliates and Partners harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against ‘Us’ by any third party due to, or arising out of, or in connection with your use of TenantsForum.net or any of the services offered on the website.

 

10. To the maximum extent permitted by applicable law, in no event shall TenantsForum LLC/It’s Affiliates/Parners be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, TenantsForum LLC/It’s Affiliates & Partners assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

11. TenantsForum LLC reserves the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the State of New York, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Queens County, New York.

 

The Tenants Forum is a gathering [User Community’] of Regulated Tenants across the City & State of New York brought together by TenantsForum LLC. Your use of the Forum & our services makes you a member of the community - eligible to receive Notifications & Updates.

 

*Note 1: Your account profile is public upon sign-in. So, your posts and comments are visible & reach other members of the Forum.

You may set your profile to ‘Private’ at Settings in your account dashboard.

 

      *Note 2: Any user of the Forum can always opt-out and exit the website entirely. Or you may opt out of the Community-Forum by setting your profile to ‘Private’ at Settings in your account dashboard so your profile will no longer be publicly visible, and you can still access our ‘Consult-A-Specialist’ Service for privacy.
